1. Terms and Conditions

1.1

OrKev’s terms and conditions: OrKev offers you access to its website services on these terms and conditions. By registering, you accept these terms and conditions. If you choose not to accept these terms and conditions, you will not be able to register and you must not utilise the services.

1.2

Amendment of OrKev’s terms and conditions: From time to time, we may amend these terms and conditions in whole or in part. Any such amendment will be effective immediately. These amendments will be available on our website at all times. As a user, you are responsible for familiarising yourself with all updated terms and conditions.

2. General

2.1

OrKev provides a means for advertisers to advertise jobs and to place other advertisements on it’s website and for job seekers to access and respond to such job advertisements. Other than providing the website as a means for this, OrKev does not participate in any way in this process.

2.2

As OrKev is not a party to any transaction between job seeker and advertisers, you agree not to involve, or attempt to involve OrKev in any dispute or in the resolution of disputes that arise between you and another user member as a result of the Services provided.

2.3

OrKev does not verify the genuineness of the job advertisements nor that of the job respondent. You agree that OrKev is not responsible or liable for any misunderstanding or misconduct between the parties. Further, OrKev provides no undertakings, representations, or warranties in relation to this.

2.4

You understand and agree that:

1. You use the services at your own risk. This website is currently under development and services are provided on an "as is" and "as available" basis.
2. While OrKev will use reasonable endeavours to ensure the availability of the website and services, the website is still under development with the potential for system unavailability or corruption of any data or user member profiles.
3. OrKev does not guarantee that the service provided will be free of any interruption or error free or reliable all the time.
4. OrKev is not responsible for the content of any advertisements displayed on this website. Further, OrKev does not endorse or recommend any product advertised on its website.
5. OrKev accepts credit card payment, but the transaction is done entirely by the bank.
6. If OrKev does not exercise or enforce any right available to it under these and amended terms and conditions, this does not by any means constitute a waiver of any of those rights.
7. You agree that, to the maximum extent permitted by law, OrKev’s liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, and consequential and incidental loss caused by your ability or inability to use the services or other member’s use of service.

2.5

You agree to release OrKev, indemnify and keep OrKev indemnified from and against all actions, all claims, any costs, proceedings, damages, any losses or liabilities, incurred by OrKev to any person arising out of or in connection with your failure to comply with OrKev’s terms and conditions.

3. Your Obligations As A User Member

3.1

Becoming a user is free. You must agree to these terms and conditions before using this website.

3.2

You warrant that you have provided complete, accurate and current personal information when registering as a user member. You must maintain and update your personal information at all times.

3.3

OrKev reserves the right to decline to register you as a user or advertiser or to terminate your user membership without entering into further discussions with you.

3.4

You warrant that you will keeping your login and password information confidential and only use it when logging into the website. You are responsible for all actions through your login. Your login and other details are for your use only.

4. Your Obligations As An Advertiser

4.1

You will only place genuine advertisements. You will also hold legal authority to advertise to sell your product, where regulatory compliance is required.

4.2

You will not list anything that is illegal, offensive, defamatory, pornographic, racially or ethnically objectionable, stolen, anything that infringes copyright, or anything that infringes intellectual property rights. or any item of the sale of which is prohibited by law.

4.3

Advertisements are not pre-screened by us for content. However, any items reported to us as unsuitable will be checked by us and removed if it breaches our terms and conditions.

5. Other

5.1

You must not deliberately or otherwise interfere or attempt to interfere or damage the Website or Services at any time.

5.2

If you have not logged on to the Website for a period of 12 months, your membership will be suspended.

5.3

OrKev does not rent or supply information about users or advertisers to any third party. The information may be supplied to law enforcers if we are required to do so by law.

5.4

OrKev owns all proprietary and intellectual property rights in the website, including the logo and the software and other material which forms part of the website and its services.

6. Fees

6.1

OrKev charges fees for advertisements placed on the Website and its use.

6.2

OrKev reserves the right to change the fees charged for our Services at any time.

6.3

For transactions in New Zealand, all fees are inclusive of GST.

7. Refunds

7.1

If vouchers are purchased, but not used within the time span, then no refund will be made. However, on a case by case basis, additional time up to three months for the use of vouchers may be permitted.

7.2

No refund will be made once a voucher is purchased and an advertisement placed on the website.

7.3

If the website is non-functional during the time that an advertisement is placed on the website, OrKev will provide additional days for the advertisement to run or refund the money if it is a single voucher purchase. If it was a bulk purchase, no refund will be made, but the advertisement will be allowed to run for equivalent additional days. In the case of promotional free advertisements, no refunds will be made, but additional time will be provided for the advertisements to run.
